GPL license and templates: things you should keep in mind

The GNU General Public License is intended to guarantee your freedom to share and change free software – to make sure the software is free for all its users. This General Public License applies to most of the Free Software Foundation’s software and to any other program whose authors commit to using it. (Some other Free Software Foundation software is covered by the GNU Library General Public License instead.) You can apply it to your programs, too.

Is it okay to keep the template sample images on my site or should I change them?

You can keep the sample data images on your website but only as a part of the template. Do not use the template sample images for any other projects of yours. Any kind of separate usage or distribution is strictly prohibited.

Will I be able to remove the templatemonster reference from template footer?

Yes, you will be able to remove the TemplateMonster reference from your website. You can contact Technical Support team to get instructions for your specific template.

Does a watermark covers logo after purchasing?

No, it doesn’t. The watermarks are not present on your purchased logo template. We add watermark to protect our template from fraud .

If I buy a template, do I have exclusive ownership of it?

You will get exclusive ownership only in case purchasing the template by unique price, and you will get it on your customized website, as for original template files, copyright remains ours.

Do I have to provide a link back or give you credit for the design?

No, we neither require any reference links to our site, nor any credits on our design of your template. After purchasing the template you are allowed to make any changes you need, and add any information you wish about the website’s manufacturers.

Do you have any warranties from independent design providers?

We strictly control uniqueness and originality of the templates, created by our designers. Out-office designers are working according to our Freelance non-exclusive License Agreement. Which claimed that the files provided by designer, should be unique, include only legal sources, do not violate any copyright, and also files should not be published before .

Do you provide references on live websites, build on your templates?

Unfortunately due to our non-disclosure agreement, we are not allowed to provide you with live examples of our customer website, build on templates from our store.

How can I get exclusive rights of this logo?

If you are interested in getting exclusive rights of the logo, you can easily purchase a logo template with “0? downloads by unique price and then register it. As you will purchase logo template by “Unique” price, it will be immediately removed from our database forever, so nobody will be able to purchase it.

How to find out how many people downloaded a template?

You can check download statistics on template preview page, field ” Downloads” will display the current number of downloads of that particular template.

How to report a piracy?

In case you’ve noticed violation of our products copyright, it will be highly appreciated if you contact our Copyright and Legal Affairs Department by submitting a ticket at https://support.template-help.com/Tickets/Submit to report an infringement. The information that you submit will be held confidentially and will help us to defend the uniqueness and quality of our products.

If I develop websites for customers, can I use your templates?

Yes, you are free to purchase our templates for your client’s websites. This is a great solution for designers who wish to provide their customers with high-quality template but do not have enough time to start a new design from the scratch. However, since we do not handover the reselling rights you will be able to provide your customer with the public website part only.

Meaning, that your customer will own only those files which are viewable through the web browsers. None of the original design sources such as Fonts, .psd and .fla sources may be transferred to another person without the prior written permission from our company.

Can I buy a template and put it on any number of web sites?

It depends on type of license that you have purchased. A regular license allows only one publication, on one server only. If you need to use the template on several domain, you will have to purchase that template for each website separately. But in case purchasing the template with a unique license you can use the template for an unlimited number of projects with no additional licensing fees.

About using a template on several sub domains, let’s say you have a domain as www.mywebsite.com with three sub domains:

• – toys.mywebsite.com 
• – shoes.mywebsite.com 
• – books.mywebsite.com

If you are going to use www.mywebsite.com as your domain name you won’t need to purchase 3 templates more for your sub domains. This is under our “ Terms of Use”. So if you have one web site with several sub domains you can use one template for that.

But in case using 2 or more different domains e.g. www.mywebsite.com and www.mynewwebsite.com then you need to purchase 2 licenses for the same template. In other words, you will need to purchase this template twice.
Please, use the following dictionary for the reference:

DOMAIN NAME – a name that is entered into a computer (e.g. as part of a Web site or other URL, or an e-mail address) then looked up in the global Domain Name System (DNS) which informs the computer of the IP address (es) assigned to that name.

WEBSITE – a website or Web site is a collection of web pages typically common to a particular domain name or the sub domain on the World Wide Web in the Internet.

In case I purchased a template and never used it – can I sell it?

According to our Terms of Use you are strictly prohibited to resell a template even if you have not used it. You can resell it only as a new customized project to your customer.

Is the price of the template a one-time fee?

Template price is one-time fee, with all taxes included. We provide lifetime usage licenses. There is no usage time limitations or additional charges. You may use the template as long as you need.

Is there any unchangeable signature in the template?

What is the difference between “Price” and “Unique Price”?

Non-unique price:

When purchasing our templates at a non-unique price, you will get all source files of the template, so you will be able to modify everything according to your preferences. Also you are allowed to customize and resale the ready made website based on the template in as one project only. Though, this is so for one purchase only. However, you are not allowed to reuse, amend or resale the template, put it up for sale or set up for a variety of purposes.

Unique price:

If you really want to own the full rights on the template, we offer you a “Unique Price” , you will gain the full rights to the particular template and this is granted for any use according to your desire. Also the template is erased from our database and you become the sole owner. In other words, you get the license to use the template, although the right to use the design and the idea with all of the derivatives is considered the private property of our company.

Will I hold the copyright to a finished website?

The initial design copyright remains with the original template designer. If royalty-free images are used within the template, the copyright for those images remains with the original photographer or illustrator. Any text and original images which you include on your pages belong exclusively to you and you hold the copyright on those items.

Can I change the domain my template is assigned to?

Q: I bought a template and it is assigned to one domain, but I would like to move it to a different domain.

A: No problem. Just delete the template from the first domain, and install it on new one. If you want the template to be on both domains, you will need to buy an additional license. We can provide you with a discount on this.

Can I resell a purchased template?

Q: I would like to know if there is any legal or ethical obligation in regards to reselling a purchased template.

A: You may not place any of our products, whether modified or not on a diskette, CD, a website or any other alternative and offer them for another distribution or resale of any kind without prior written consent from our company.

Can I use the graphics and layout of your site?

Unfortunately you are allowed to use graphics and layout within our template only! Stealing our layout or images is strictly forbidden and is violated at our copyrights. We guarantee the swift legal action against anyone who steals our images, layout, style, intellectual property, ideas, bandwidth or page content.

Our refund policy

Imagery, cliparts and fonts

All imagery, clipart and fonts used in our products are royalty-free and are the integral part of our products. One Time Usage License and Developers License give you the right to use images, clipart and fonts only as a part of the website you build using your template. You can use imagery, clipart and fonts to develop one project only. Any kind of separate usage or distribution is strictly prohibited. All images and illustrations used in templates come in a single layer, as is.

Some of the templates that are animated with the Flash technology may contain effects created with the following software packages: Adobe AfterEffects, 3DMax. If you want to check what effects are included in certain template please address our Support Team for further consulting. Please notice that you will need to have special software(which you can check at each template preview)for editing the files. The alternate variant is to hire someone to do it for you.

Template Licenses

1) One time usage license

You may be granted a One Time Usage License in case of purchasing a website template at a Non-Unique Price. It enables you to use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template again if you want to use the same design in connection with another or other projects;

2) Developers license

You may be granted a Developers License that entitles you to make some modifications with the products using any software or applications and our designs. You are permitted to redistribute or resell your projects after the receiving the license. You can apply for the license at developerslicense@template-help.com;

3) Buyout purchase license

You may be granted a Buyout Purchase License in case of purchasing a website template at a Buyout Purchase Price. This type of license guarantees that you are the last person to buy this template. After the buyout purchase occurs, the template is permanently removed from our sales directory and is never available to other customers again. You can not redistribute or resell templates after Buyout Purchase Price.
